Requirements for Obtaining Design Protection

For an industrial design registration to be successful, your design must legally meet two basic criteria:

  • Novelty: The design must not have been disclosed anywhere in the world prior to filing the application.

  • Individual Character: The appearance must clearly differ from existing designs and must not be confusingly similar. Registration is not possible for designs that violate public order, accepted principles of morality, or are identical to previously registered rights of third parties.

Exclusive Rights of the Industrial Design Owner

By registering, you gain the exclusive right to use, manufacture, and market this design. As the owner, you can also license, sell, or transfer your rights. If the design is created by an employee as part of their work duties, the right to protection typically transfers to the employer (client).

Validity and Renewal of Protection

Industrial design protection is valid for 5 years from the filing date of the application. We can repeatedly renew this period for you every 5 years, up to a maximum total of 25 years. In case of a missed deadline, protection can still be renewed within a grace period of 6 months for an additional fee.

Territorial Scope: Where to Protect Your Design?

Based on your business goals, we will help you choose the optimal path:

  • Czech Republic (National Route): Registration with the Industrial Property Office (ÚPV) in Prague. Ideal for the local market.

  • European Industrial Design (Community Design – CD): With a single registration at the EUIPO, you obtain protection across all EU member states.

  • International Route (WIPO): Allows you to protect up to 100 different designs in more than 55 countries worldwide with a single application.
